1. Overview
Welcome to the Unicorn Platform Affiliate Program! Affiliates earn commissions for eligible referrals, defined as new customers who purchase a paid subscription plan via your link, subject to these terms and conditions.
2. Eligibility
- Participants must be 18 years or older and maintain a valid account on unicornplatform.com.
- Affiliates must provide and maintain accurate contact and payment information (e.g., valid PayPal email address) via the affiliate dashboard. Failure to update information within 30 days of a change may result in delayed payments.
- Unicorn Platform reserves the right to approve or reject applications based on factors such as promotional methods, website content, or history of fraudulent activity. Rejected applicants will be notified with a general reason for denial.
- Affiliates must comply with all applicable laws, including U.S. FTC guidelines on disclosing affiliate relationships (e.g., using “#ad” or “affiliate link” in promotions).
3. Affiliate Responsibilities
- Affiliates must use their unique affiliate link, provided upon registration, to track referrals.
- Promotions must be ethical, accurate, and compliant with applicable laws, including but not limited to U.S. FTC guidelines, GDPR (for EU residents), and CAN-SPAM Act (for email marketing). Affiliates must clearly disclose their affiliate relationship in all promotional content.
- Affiliates are responsible for ensuring their promotional content does not infringe on third-party intellectual property rights.
4. Prohibited Activities
Affiliates are strictly prohibited from using their affiliate links in any paid advertising platforms, including but not limited to Google Ads, Facebook Ads, or any other pay-per-click (PPC) or paid media campaigns. Violation of this rule will result in immediate termination from the affiliate program and forfeiture of all pending commissions.
Prohibited activities include:
- Spamming (e.g., sending unsolicited emails to purchased lists or posting links in irrelevant forums).
- Deceptive marketing (e.g., false claims about Unicorn Platform’s services, such as guaranteed search rankings).
- Using affiliate links on websites or platforms promoting illegal, offensive, or inappropriate content (e.g., hate speech, adult content).
- Cookie dropping, forced redirects, or other methods that trigger tracking without user consent.
Violations may result in warnings, commission deductions, or termination, as outlined in Section 6.
5. Commission Structure
- Affiliates earn a commission for each new customer who purchases a paid Unicorn Platform subscription plan via their affiliate link, as tracked by a 30-day cookie window.
- A “new customer” is defined as a user who has not previously subscribed to Unicorn Platform and completes a valid, non-fraudulent transaction. Fraudulent transactions include self-referrals, fake accounts, or chargebacks.
- Commissions are paid monthly. Payments are processed within 15 days of the month’s end.
6. Termination and Penalties
Unicorn Platform may issue warnings, deduct commissions, or terminate participation for violations of these terms, depending on severity:
- Moderate violations (e.g., unapproved paid advertising): Deduction of related commissions and 7-day correction period.
- Severe violations (e.g., spamming, deceptive marketing): Immediate termination and forfeiture of pending commissions tied to the violation.
Affiliates may appeal terminations or commission deductions via support@unicornplatform.com within 14 days. Unicorn Platform will review appeals and respond within 14 business days.
Unicorn Platform may terminate the affiliate program or an individual’s participation with 30 days’ written notice via email or the affiliate dashboard.
7. Tracking and Reporting
- Affiliate referrals are tracked via cookies and server-side methods, with a 30-day cookie window from the user’s initial click.
- Affiliates can access real-time performance data (e.g., clicks, conversions, commissions) via the affiliate dashboard.
- Unicorn Platform strives to ensure accurate tracking but is not liable for lost commissions due to user actions (e.g., disabling cookies) or technical issues beyond its control. Affiliates are encouraged to use Unicorn Platform-provided tracking tools to minimize discrepancies.
8. Liability
- Unicorn Platform is not liable for indirect, incidental, or consequential damages (e.g., lost profits) arising from participation in the affiliate program.
- Affiliates are solely responsible for any taxes, legal obligations, or costs related to their earnings. Unicorn Platform will provide necessary tax forms as required by law.
9. Modifications
- Unicorn Platform may modify these terms at any time. Affiliates will be notified via email and a prompt in the affiliate dashboard. Significant changes (e.g., commission rate adjustments) will include a 30-day grace period for compliance.
- Continued participation after notification constitutes acceptance of the updated terms.
10. Dispute Resolution
- Disputes (e.g., commission denials, terminations) must be submitted in writing to support@unicornplatform.com within 14 days of the issue. Unicorn Platform will respond within 7 business days.
- If unresolved, disputes may proceed to mediation in Delaware, USA, with costs shared equally by both parties.
11. Governing Law
These terms are governed by the laws of Delaware, USA, without regard to conflict of law provisions. Any disputes will be resolved in the courts of Delaware.
